This “Privacy Policy” governs the processing of your personal data by Brasserie Lefebvre sa, having its registered office in Belgium, Chemin du Croly 54, 1430 Rebecq, registered under the company number 0427.734.366, (hereinafter: Brasserie Lefebvre).

Article 1 – What personal data do we process?

1.1. Brasserie Lefebvre processes your Personal Data as part of its activities. This concerns:

    • Category 1, based on cookies: your IP address and details of your visit to our website and your browsing habits, your origin, your search terms;
    • Category 2,during registration or via one of the forms on our website: your first and last name, possibly your company name and VAT number, your contact details, your email, and any other information you provide in the free text field;
    • Category 3, if you call us or send us an email: your phone number and/or email address, as well as the data you provide yourself;
    • Category 4, when subscribing to our newsletter: your email address;
    • Category 5, when placing an order in our shop: your first and last name, possibly your company name and VAT number, your contact details, and your email.

General purposes: Brasserie Lefebvre will use your personal data only for:

    • Category 2 and 3: Responding to questions and information requests, with the legal basis being the execution of the service you requested;
    • Category 2, 3, and 4: Direct marketing, newsletters, actions, and promotions by Brasserie Lefebvre itself, the legal basis being our legitimate interest regarding existing customers or your explicit and prior consent if you are not yet a customer at Brasserie Lefebvre. You can indicate at any time that you no longer wish to receive our newsletters by using the unsubscribe option included in our newsletters or by contacting us directly by email or phone;
    • Category 5: The delivery and invoicing of products or services you have ordered, with the legal basis being the execution of a contract you have requested and for which the processing of your personal data is necessary or because it is required by law or because Brasserie Lefebvre has a legitimate interest.

Article 2 – For what purposes do we use your personal data?

    • Category 5: The delivery and billing of products or services you have ordered, with the legal basis being the execution of a contract you have requested and for which the processing of your personal data is necessary or because it is required by law or because Brasserie Lefebvre has a legitimate interest.

Article 3 – How we share your data with third parties

If one day we cease our activity or transfer our business to someone else, for example, if we go bankrupt or sell our business, this may involve the transfer of your personal data to third parties who will take over the whole or part of our business. As far as possible, Brasserie Lefebvre will inform you in advance, but you understand that this may not be technically or commercially feasible in all circumstances.

In rare circumstances, we may be required to disclose personal data under a court order or to comply with other mandatory laws or regulations. We will try to inform you in advance as far as possible, except when we cannot do so for legal reasons.

We may share your data with third parties whose services we use in the context of your ordering process and your order. Your data may be transmitted and processed by software and cloud providers, financial partners, logistics partners, or any other third party that is a stakeholder or plays a role in your order. The current list can be obtained upon simple request by email. For each transfer to a third party, we ensure appropriate security measures regarding your personal data, including the conclusion of processing contracts if necessary.

We always try to use European providers as much as possible and to keep your data in Europe as far as possible. If we need to use non-European third parties, we ensure that your data is as secure outside the European Union as it is here. Thus, when necessary, we conclude Standard Contractual Clauses with these partners and provide additional guarantees.

Currently, your personal data can exclusively be processed by: Google Analytics, WordPress, and Mailchimp. 

Article 4 – How long do we keep your personal data?

We keep your personal data as long as necessary for the purposes of any processing.

    • Customer profile: if you do not place an order for 3 years, we will delete your customer profile.
    • Billing data: for legal reasons, we must keep your billing data for at least 10 years from the calendar year following the last billing date.
    • Newsletters: if you are an existing customer, we keep your newsletter data for 3 years after your last order. If you are not an existing customer and you have given your consent for newsletters, we will keep your data until you withdraw your consent. 

Article 5 – Your Rights

You have the right to inquire at any time and free of charge about your personal data and how we use it or to request a copy. You also have the right to request correction or (in certain cases) deletion of your data. You can also request that the processing of your personal data be restricted in a number of cases listed in the GDPR. You have the right to object to the processing of your personal data if you have serious and legitimate reasons that outweigh our need to process your data or to withdraw a previously given consent. You also have the right to object at any time to the use of your personal data for direct marketing purposes, even without providing a reason. You have the right to request your personal data in a digital and readable format and/or to have it transferred to another service provider of your choice.
